A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF
COLUMBIA

Chairman Linda W. Cropp at the request of the Mayor, introduced the following
resolution, which was referred to the Committee on _____.

To confirm the Mayoral appointment of Mr. Patrick E. Kelly as the Commissioner of the
Department of Insurance and Securities Regulation.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited
as the "Commissioner of the Department of Insurance and Securities Regulation Patrick
E. Kelly Confirmation Resolution of 1998".

Sec. 2. The Council of the District of Columbia confirms the
appointment of:

Mr. Patrick E. Kelly

as the Commissioner of the Department of Insurance and Securities
Regulation, in accordance with section 2 of the Confirmation Act of 1978, effective March
3, 1979 (D.C. Law 2-142; D.C. Code, sec.1- 633.7), to serve from the date of confirmation
by the Council of the District of Columbia at the pleasure of the Mayor of the District of
Columbia.

Sec. 3. The Council of the District of Columbia shall
transmit a copy of this resolution, upon its adoption, each to the nominee and to the
Office of the Mayor.

Sec. 4. This resolution shall take effect immediately.

EXPERIENCE

June 1997 to Present. Interim Commissioner.

Department of Insurance and Securities Regulation

As chief regulator of the insurance and securities industry in the District of Columbia
administers the D.C. insurance and securities laws and regulations. Oversees the Insurance
Bureau including the financial examination process; financial analysis: tax and assessment
of insurance companies; analysis of forms, policy and rate filings for insurance
companies. Also ensures that consumer inquiries and complaints are properly addressed;
that individual agent and company licenses are properly handled and issued; and ensures
that allegations of fraud by insurance agents, brokers and companies are appropriately
investigated and handled. Manages the principal functions of the Securities Bureau.
Monitors all work in progress to ensure that the approach, analysis, and strategy used is
appropriate. Reviews all final documents for soundness of approach. consistency with
department policy and practice and thoroughness. Develops policies to govern all phases of
securities activities in the District of Columbia. Establishes rules. regulations. and
procedures that govern all aspects of the District’s securities regulation. including the
registration and sale of securities; the licensing and registration of professionals
authorized to operate in the District as broker-dealers and their agents. agents of
issuers. and investment advisors; and the establishment and collection of related fees.
Confers with securities regulatory agencies and securities related entities regarding
legislation, negotiation of settlements and disposition of cases. Recommends new
legislation and amendments to existing legislation when necessary. Serves as Hearing
Officer in complex insurance and securities cases and renders final decisions that include
findings of fact and conclusions of law. Chairs the Insurance Advisory Committee. Chairs
the National Association of Insurance Commissioners (NAIC) Market Conduct Examination
Oversight Taskforce and is a member and participant of seven other NAIC special
committees. Prepares and delivers testimony to the Council of the District of Columbia for
the Executive. Prepares and delivers speeches to insurance and securities entities as
requested. Hosted NAIC meetings with over 5.000 participants.

January, 1995 to July 1997. Interim Commissioner

Insurance Administration

Department of Consumer & Regulatory Affairs

Was the chief regulator of the Insurance Administration. Managed all aspects of the
administration’s daily operations. Administered the D.C. insurance laws and regulations.
Responsible for overseeing the financial examination, financial analysis, tax and
assessment of insurance companies; ensured that forms, policy and rate filings for
insurance companies were properly analyzed: ensured that consumer inquiries and complaints
were properly addressed; that individual agent and company licenses were properly handled
and issued; and ensured that allegations of fraud by insurance agents. brokers and
companies were appropriately handled and investigated. Acted as Hearing Officer in complex
insurance cases. Chaired the Insurance Advisory Committee. Chaired the NAIC Market Conduct
Examination Oversight Taskforce. Member and participant in seven other NAIC special
committees. Prepared and delivered testimony to the D.C. Council for the Executive.
Prepared and delivered speeches to insurance entities. Instituted a Community Outreach
program for D.C. insurance consumers. Hosted NAIC meetings with over 5,000 participants.

August 1992 to December 1994. Deputy Superintendent of Insurance.

Insurance Administration

Department of Consumer & Regulatory Affairs

Administered D.C. insurance laws. Responsible for the daily operation of the
administration including personnel, budget organizational and operational issues.
Maintained oversight of the licensing process; financial audits of companies; rate
regulations: servicing of consumer service requests and administration of premium and
retaliatory tax laws. Proposed and instituted new policies and procedures. Proposed new
legislation and regulations and revisions to existing laws and regulations. Represented
the administration before government agencies as well as the insurance industry.

February 1985 to August 1992. Program Manager.

Insurance Administration

Department of Consumer & Regulatory Affairs

Served as Supervisor of the Licensing Division. Responsible for total coordination,
monitoring and administrative evaluation of processing of insurance applicants in
accordance with federal and local statutes governing the insurance industry. Reviewed and
investigated complaints against insurance company officials. brokers, agents and
solicitors regarding allegations of misconduct, and violation of laws. Interpreted laws
and regulations pertaining to licensing matters. Participated- in hearings involving
insurance issues. Drafted licensing legislation. Served as principal Deputy to the
Superintendent of Insurance.

March 1983 to February 1985. Special Assistant to the Director.

Department of Consumer and Regulatory Affairs

Served as the Equal Employment Opportunities adviser to the Director. Specifically
advised the Director on EEO matters related to the preparation of plans. procedures and
regulations. Assisted in the development of Unfair Labor Practices cases. Represented the
Department in union matters and before the Office of Labor Relations and Collective
Bargaining in connection with complaints; representation issues and proposed policies.
Conducted informal and formal hearings.

August 1974 to March 1983. Legislative and Regulations Officer

Department of Licenses, Investigations and Inspections

Performed review of codes and regulations to determine conflicts and ambiguities.
Drafted new engineering codes and regulations. Administered laws, codes and regulations
that regulated construction; mechanical and electrical installations; business and
callings; municipally owned markets and housing and occupation professions in the District
of Columbia.

March 1973 to August 1974. Legislative Assistant

United States House of Representatives, Congressman John Conyers, Jr.

Responsible for advising the Congressman on pending legislation before his
subcommittees. full committees and the full house. Responded to legislative mail. Advised
the Congressman as to legislative strategy on particular bills. Attended legislative
strategy meetings and advised Congressman of the course of action and probable results.
Wrote articles for the "extension of remarks" section of the Congressional
Record. Wrote speeches and speech outlines for the Congressman. Became familiar with all
phases of congressional work.

June 1971 to February 1973. Assistant Counsel

United States House of Representatives, Congressman John L. McMillian

Served as Assistant Counsel to the House Committee on the District of Columbia.
Researched proposed legislation that affected the District of Columbia. Research involved
meeting with various interest groups and attorneys to obtain their opinions and reactions
to pending legislation. Also researched the legal aspects of proposed legislation. Briefed
the Congressman as to the feasibility and affect of proposed legislation.

ACCOMPLISHMENTS

  • Achieved and maintained NAIC accreditation through 1998.
  • Supervisor of the Year – Department of Consumer & Regulatory Affairs
  • Assisted in the structure of the 60 million dollar bailout of the Blue Cross and Blue
    Shield of the National Capital Area.
  • Obtained special legislation funding insurance regulation through an annual assessment.
  • Insurance regulatory function elevated to Cabinet level status.
  • Assisted in the realignment of the insurance regulatory function to include a
    state-of-the-art agent/broker licensing system and data communications systems permitting
    electronic rate filings and imaging capability to achieve a paperless work environment.
  • Established and maintained public/private partnerships with several insurance companies.
  • Initiated a community outreach consumer education program targeted at District of
    Columbia senior citizens that addresses insurance matters.
  • Organized and conducted fifteen ( 15) consumer education workshops throughout the
    District of Columbia.
  • Appointed Chairperson of the NAIC Market Conduct Examination Oversight Task Force.
  • Appointed Vice Chairperson of the NAIC Life Insurance Committee (A).
  • Member of seven NAIC special committees.
  • Hearing Officer for the Mayor.
