A PROPOSED. RESOLUTION IN THE COUNCIL OF THE DISTRICT OF
COLUMBIA
To declare the existence of an emergency, with respect to the need to strengthen
financial and management controls to permit a fiscal year 1999 reprogramming of funds for
Advisory Neighborhood Commissions.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited
as the "Advisory Neighborhood Commissions Management Control and Funding Emergency
Declaration Resolution of 1998".
Sec. 2. (a) Although the Council, Mayor, and Financial Authority
allocated $573,000 to Advisory Neighborhood Commissions ("ANCs") in the
District’s fiscal year 1999 budget, Congress eliminated the $573,000 allocation when it
approved the District’s budget.
(b) Congress also stated in the conference report accompanying the District’s FY 99
appropriation bill that the District government could reprogram funds for ANCs, "so
long as necessary management controls are enacted by the Council of the District of
Columbia to assure that the funds are disbursed for previously reviewed and agreed upon
purposes, consistent with the laws, rules, and regulations of the District of
Columbia."
(c) Advisory Neighborhood Commissions are vital elected institutions created by the
Home Rule Act to advise the Mayor and Council about neighborhood issues and concerns and
to undertake neighborhood improvement projects.
(d) Advisory Neighborhood Commissioners elected in November 1998 will take office in
January 1999 and need funding to carry out the duties prescribed in the Home Rule Act.
(e) It is necessary for the District government to act quickly to institute additional
management and financial controls on ANCs to facilitate a fiscal year 1999 reprogramming
so that ANC commissioners can fulfill the duties outlined in the Home Rule Act.
Sec. 3. The Council of the District of Columbia determines that the
circumstances enumerated in section 2 constitute emergency circumstances making it
necessary that the Advisory Neighborhood Commissions Management Control and Funding
Emergency Amendment Act of 1998 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
