A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
Councilmember Schwartz, Councilmember Catania, and Councilmember Mendelson introduced
the following bill, which was referred to the Committee on Government Operations.
To amend the District of Columbia Administrative Procedure Act of 1979 to provide for
the regular compilation of complete and current versions of the District of Columbia
Municipal Regulations (DCMR), to require that an electronic version of the DCMR be made
available through the internet, and to provide that the Mayor may enter into agreement
with private contractors of database services to offer electronic versions of DCMR.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as
the "District of Columbia Municipal Regulations Publication Improvement Amendment Act
of 1999".
Sec. 2. Section 305 of the District of Columbia Administrative Procedure Act, effective
March 6, 1979 (D.C. 2-153; D.C. Code § 1-1535), is amended as follows:
"(305)(a) The Mayor shall, within sixty (60) days of the effective date of this
legislation, compile a complete and current version of the DCMR, with all sections
codified by subject matter, with an index to the sections;
"(b) The Mayor shall publish, no later than sixty (60) days after the beginning of
each fiscal year, a cumulative supplement to the DCMR containing all newly promulgated
DCMR provisions;"(c) The Mayor shall make available, within (60) days of passage of this
legislation, an electronic version of the official text of the DCMR through the internet,
with all sections codified by subject matter, with an index to the sections, integrating
all newly promulgated DCMR provisions since the last version;(d) The Mayor shall update the electronic version of the official text of the DCMR
prior to the effective date of any newly promulgated DCMR provisions, integrating the
newly promulgated DCMR provisions since the last version;(e) The Mayor may enter into agreement with private contractors of database services to
offer the DCMR in an electronic version."
Sec. 3. Fiscal impact statement.
The Council adopts the fiscal impact statement in the Committee report as the fiscal
impact statement required by section 602(c)(3) of the District of Colombia Home Rule Act,
approved December 24, 1973(87 Stat. 813; D.C. Code §1-233(c)(3).
Sec. 4. Effective date.
This act shall take effect following approval by the Mayor (or in the event of veto by
the Mayor, action by the Council to override the veto by the Council), and approval by the
Financial Responsibility and Management Assistant Authority as provided in section 203(a)
of the District of Columbia Financial Responsibility and Management Assistant Act of 1995,
approved April 17, 1995 (109 Stat. 116; D.C. Code § 47-392.3(a)), a 30 day period of
Congressional review as provided in section 602(c)(1) of the District of Columbia Home
Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code §1-233(c)(1)), and the
publication in the District of Columbia Register.
