A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT
OF COLUMBIA

Chairman Linda W. Cropp, at the request of the Mayor, introduced the
following resolution, which was referred to the Committee on Public Works
and the Environment.

To approve a proposed rule to amend Chapter 1, Title 18, to provide for
a youth identification card.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the "Youth Identification Card
Resolution".

Sec. 2. Pursuant to title VIII of the Motor Vehicle and Safe Driving
Amendment Act of 2000, effective April 27, 2001, (D.C. Law 13-289) the
Council approves the proposed rule, transmitted to the Council by the
Mayor on ______, which would amend Title 18, ("Traffic
Regulations") of the District of Columbia Municipal Regulations,
Chapter 1, to establish a youth identification card.

Sec. 3. A copy of this resolution shall be transmitted to the Mayor.

Sec. 4. This resolution shall take effect immediately upon the first
date of publication in either the District of Columbia Register, the
District of Columbia Statutes at Large, or in the District of Columbia
Municipal Regulations.

NOTICE OF PROPOSED RULEMAKING

The Director of the Department of Motor Vehicles, pursuant to the
authority set forth in Section 1425 of the Department of Motor Vehicles
Establishment Act of 1998, effective March 26, 1999, 45 DCR 4794 (D.C. Law
12-175; D.C. Code § 40-151 et seq. (1999 Supp.)) and Title VIII of the
Motor Vehicle and Safe Driving Amendment Act of 2000, effective April 27,
2001, 48 DCR 2057 (D.C. Law 13-592), hereby gives notice of her intent to
adopt the following rulemaking which amends Chapter 1 of Title 18 of the
District of Columbia Municipal Regulations (DCMR) (Vehicles and Traffic).
The proposed amendment will establish a youth id for children between the
ages of 2 and 14. Final rulemaking action shall not be taken in less than
thirty (30) days from the date of publication of this notice in the D.C.
Register.

Pursuant to title VIII of the Motor Vehicle and Safe Driving Amendment
Act of 2000, effective April 27, 2001, (D.C. Law 13-289), these proposed
rules are being transmitted to the Council of the District of Columbia,
and the final rules may not become effective until the expiration of the
fortyfive (45) day period of Council review or upon approval by Council
resolution, whichever occurs first.

The following rulemaking action is proposed:

Title 18, DCMR, is amended as follows:

A. Chapter 1 is amended as follows:

1) Subsection 112.2 is amended by adding after the words
"fifteen (15)" the phrase "except that a Youth
Identification Card may be issued to residents between the ages of two
(2) and fourteen (14) as set forth in section 113,".

2) By adding a new section, 113, to read as follows:

113 YOUTH IDENTIFICATION CARDS

113.1 The Department of Motor Vehicles may offer, on a voluntary
basis, a youth identification card, which may contain the name,
address, photograph and such other identifying data that the Director
may prescribe.

113.2 The Youth Identification Card shall only be issued to
residents of the District between the ages of two (2) and fourteen
(14), upon payment of a fee, if a fee is required, and submission of
an application by the youth, the youth’s parent or legal guardian, or
the educational institution in which the youth is enrolled.

113.3 The Youth Identification Card shall expire every two (2)
years, but may be renewed upon request and payment of the fee, if a
fee is required.

113.4 No police officer shall be authorized to
request presentation of the card authorized
by
this section as a means of identification, although the same may be
volunteered
by the bearer for that
purpose.

113.5 The Director may charge a fee for the
two (2) year Youth Identification Card of up
to
$5.

All persons desiring to comment on the subject
matter of this proposed rulemaking should file comments, in writing, to

(30) days after the publication of this notice in the
