To require on a temporary basis the Board of Education and the District of Columbia
Public Schools to assess and place a student in an appropriate special education placement
within 120 calendar days from the date that the student was referred.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as
the "Assessment and Placement of Special Education Students Temporary Act of
1998".
Sec. 2. Assessment and placement of special education students.
(1) The Board of Education and the District of Columbia Public Schools shall assess or
evaluate a student, who may have a disability and who may require special education
services. within 60 calendar days from the date that the student was referred for an
assessment or evaluation.
(2) If a student is classified as having a disability, as provided in
section 101(a)(l) of the Individuals with Disabilities Education Act (20 U.S.C.
§1401(a)(1)) or in section 7(8) of the Rehabilitation Act of 1973 (28 U.S.C. §706 8)).
the Board of Education and the District of Columbia Public Schools shall place that
student in an appropriate special education public, private, or residential placement
within 60 calendar days from the date that the evaluation or assessment was completed
pursuant to subsection (1).
Sec. 3. Fiscal impact.
This act shall have no fiscal impact.
Sec. 4. Effective date
(a) This act shall take effect following approval by the Mayor (or in
the event of veto by the Mayor, action by Council to override the veto), approval by the
Financial Responsibility Management Assistance Authority as provided in section 203(a) of
the District of Columbia Financial Responsibility and Management Assistance Act of 1995,
approved April 17, 1995 (109 Stat. 116: D.C. Code §47-392.3(a)), and a 30-day period of
Congressional review as provided in section 602(c)(1) of the District of Columbia Home
Rule Act, approved December 24. 1973 (87 Stat. 813; D.C. Code §1-233(c)(1), and
publication in the District of Columbia Register.
(b) This act shall expire after 225 days of its having taken effect.
