PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency, with respect to the failure
of portions of a retaining wall in Square S-5542, S.E., and to authorize the Mayor to act
to abate the emergency.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, that this
resolution may be cited as the "Square S-5542, S.E., Soil Stabilization Emergency
Declaration Resolution of 1998."

Sec. 2. The Council finds that:

(a) In 1976, the O Street retaining wall was constructed to control
soil erosion and sedimentation between the 3200-3300 block of Highwood Drive, S.E., and
the 3200 block of O Street, S.E.

(b) Over time, problems have arisen in the retaining wall. The
engineering investigation conducted this year for the Department of Public Works revealed
that portions of the wall are inadequate, threatening the integrity of the entire wall,
and that repairs must be made to the wall immediately in order to ensure that the wall
continues to control soil erosion and sedimentation.

If the repairs identified in subsection (b), above, are not made, the
entire wall is at risk of collapse. This poses a serious threat to the health, safety, and
welfare of people in the area.

Sec. 3. The Council finds that the conditions enumerated in section 2
of this resolution pose a threat to the health, safety, and welfare of people of the
District of Columbia, warranting enactment of the "Square S-5542, S.E., Soil
Stabilization Emergency Act of 1998" on an emergency basis.

Sec. 4. This resolution shall take effect immediately.
