IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
June 16. 1998
To authorize the Chairman of the Council and the Chairman of the Council Committee
on the Judiciary to sign an Agreement establishing the Criminal Justice Coordinating
Council to coordinate criminal justice system activities and to provide assistance to the
Chief of the Metropolitan Police Department, and repealing the Memorandum of Understanding
concerning the Metropolitan Police Department.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited
as the "Criminal Justice Coordinating Agreement Resolution of 1998".
Sec. 2. The Chairman of the Council of the District of Columbia and the Chairman of the
Council Committee on the Judiciary are each authorized to sign an Agreement, dated May 28,
1998, regarding the coordination of the criminal justice system in the District of
Columbia, with the Mayor of the District of Columbia, the Chief of the Metropolitan Police
Department, the Chief Judge of the Superior Court of the District of Columbia, the United
States Attorney for the District of Columbia, the Corporation Counsel of the District of
Columbia, the Chief Management Officer, the Corrections Trustee of the District of
Columbia, the Offender Supervision Trustee of the District of Columbia, and three members
of the District of Columbia Financial Responsibility and Management Assistance Authority
as follows:
Sec. 3. The Council representatives are requested to urge the adoption of a requirement
that within 6 months of its first meeting, the Coordinating Council shall issue a report
to the public on its activities and recommendations and any actions taken pursuant to any
recommendation, and one month subsequent to the issuance of such report, the Coordinating
Council shall convene a public meeting at which public comment on the report will be
taken, and such a report and public meeting shall be held every 6 months for the life of
the Coordinating Council.
Sec. 4. This resolution shall take effect immediately.
AGREEMENT
May 28, 1998
This Agreement is entered into by the Mayor of the District of Columbia, the Chief of
the Metropolitan Police Department ("the MPD"), the Chair of the Council of the
District of Columbia, the Chair of the Judiciary Committee of the Council of the District
of Columbia, the Chief Judge of the Superior Court of the District of Columbia, the United
States Attorney for the District of Columbia, the Corporation Counsel of the District of
Columbia, the Chief Management Officer, the Corrections Trustee of the District of
Columbia, the Offender Supervision Trustee of the District of Columbia, and three members
of the District of Columbia Financial Responsibility and Management Assistance Authority
("the Authority") – or their respective successors — hereafter referred to
collectively as "the Parties".
WHEREAS, there is a need for coordination of the criminal justice system, the
identification of areas of mutual interest to the Parties, and the mobilization of the
resources of the Parties to improve the justice system;
WHEREAS, the Parties desire to ensure the safety of persons living, working or visiting
the District of Columbia and their property, to reduce the occurrence and fear of all
types of crime, and to improve the quality of life throughout the District of Columbia;
WHEREAS, the Parties recognize that the criminal justice system must be coordinated and
organized to permit the most effective and efficient use and deployment of personnel and
technology resources;
WHEREAS, the Parties recognize that the agencies within the criminal justice system
must recruit the finest available personnel, provide for the continuing training and
professional development of officers and personnel of all ranks, and prepare officers and
other personnel for promotion to positions of increasing responsibility;
WHEREAS, the Parties recognize that the MPD is an integral part of the criminal justice
system; that the organization, staffing and operation of the MPD should be designed to
maximize the level of police services and visibility at the community level, that the
MPD’s capacity to deal with homicide, gangs, drugs, domestic violence, and all other types
of crimes and criminal behavior must be maintained, and that the MPD must establish trust
and respect within the community;
WHEREAS, Congress in Public Law 105-174 has validated an employment agreement signed by
the Chief of the MPD, the Mayor, and the Authority.
The Parties agree that:
- The District of Columbia Criminal Justice Coordinating Council ("Coordinating
Council") is hereby established by and between the hereto signed Parties and their
successors in office; - The Coordinating Council shall use its best efforts to coordinate the activities and
mobilize the resources of the Parties in improving public safety in and the criminal
justice system of the District of Columbia; - The Parties shall cooperate with and support the Coordinating Council and each other in
carrying out the purposes of this Agreement; - The Coordinating Council shall assist the Chief of the MPD in discharging his/her
responsibilities by:- Meeting regularly with the Chief of the MPD and his/her staff to:
- Receive reports on the state of the MPD:
- Receive reports on MPD plans and operations;
- Receive reports on the latest D.C. crime statistics;
- Receive such other reports as the Coordinating Council deems appropriate relating to
crime and other law enforcement matters and to their impact on the criminal justice system
of the District of Columbia;
- Making recommendations regarding operational, organizational and personnel matters as
are believed necessary to improve public sates, in the District of Columbia and maintain
the efficiency and effectiveness of the MPD.
- Meeting regularly with the Chief of the MPD and his/her staff to:
- The Coordinating Council also shall:
- Define and analyze issues and procedures in the criminal justice system, identify
alternative solutions, and make recommendations for improvements and changes in the
programs of the criminal justice system; - Receive information from, and give assistance to, other District of Columbia agencies
concerned with, or affected by, issues of public safety and the criminal justice system; - Make recommendations regarding operational. organizational and personnel matters as are
believed necessary to improve public safety in other criminal justice agencies.

insofar as possible, by consensus. When consensus cannot be achieved, the Will of the
majority of the Coordinating Council shall prevail; - The Memorandum of Understanding dated December 10, 1996 among the Mayor, the Council of
the District of Columbia, the Chief Judge of the Superior Court, the United States
Attorney, the Corporation Counsel, and the Authority is hereby rescinded and replaced.
