A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
Chairman Linda W. Cropp introduced the following resolution at the
request of the Mayor, which was referred to the Committee on Government Operations
To declare the D.C. Village/Impoundment Lot site surplus property of
the District of Columbia and authorize the Mayor to enter into negotiations for
disposition of the property through a sale, lease, lease-purchase, or other type of
agreement, with all negotiated terms to be submitted to the Council for review and
approval prior to execution.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the "D.C. Village/lmpoundment Lot Surplus Property
Declaration and Disposition Authority Resolution of 1998".
Sec. 2. The Council of the District of Columbia-finds that:
(a) The property which is owned by the District of Columbia and is the
site of the District of Columbia Village Long-Term Care Facility and the Impoundment Lot
("D.C. Village/Impoundment Lot site") is no longer needed for District of
Columbia Government purposes.
(b) The disposition of the D.C. Village/Impoundment Lot site by means
of a sale, lease, lease- purchase, or other type of agreement with a private-sector
entity, subject to Council review and approval of the terms and use of the site, would
bring needed revenue to the District.
(c) The disposition of the D.C. Village/Impoundment Lot site to a
private-sector entity, subject to Council review and approval of the terms and use of the
site, would create opportunities for job creation and economic growth in the overall best
interests of the surrounding community and the District as a whole.
(d) The disposition of the D.C. Village/Impoundment Lot site to a
private-sector entity, subject to Council review and approval of the terms and use of the
site, is consistent with the District of Columbia Five Year Public Facilities Plan.
(e) The disposition of the D.C. Village/Impoundment Lot site to a private-sector
entity, subject to Council review and approval of the terms and use of the site, is in the
overall best interests of the District.
(f) The Mayor has recommended to the Council that the D.C.
Village/lmpoundment Lot site be declared surplus and that the Mayor be authorized to enter
into negotiations for disposition of the site to a private-sector entity.
(g) In advance of execution, any tentative agreement resulting from the
Mayor’s negotiations for disposition of the D.C. Village/Impoundment Lot site, in whole or
in part, must be submitted to the Council for review and approval in accordance with the
Disposal of District Owned Surplus Real Property Amendment Act of 1989, effective March
15, 1990 (D.C. Law 8-96; D.C. Code §9-401).
Sec. 3. (a) Pursuant to §3 of the Disposal of District Owned Surplus
Real Property Amendment Act of 1989, effective March 15, 1990 (D.C. Law 8-96; D.C. Code
§9-401), the Council of the District of Columbia hereby finds and declares that the D.C
Village/lmpoundment Lot I site is surplus property.
(b) The Council authorizes the Mayor to enter into negotiations with a private-sector
entity to seek the terms most favorable to the District for the disposition of the D.C.
Village/Impoundment Lot site by means of a sale, lease,. lease-purchase, or other type of
agreement, with the private-sector entity’s intended use of the site to be set forth with
specificity in the agreement.
Sec. 4. This resolution shall take effect immediately upon enactment.
