A BILL IN THE
COUNCIL OF THE DISTRICT OF COLUMBIA
To amend the District of Columbia Alcoholic Beverage Control Act and Title 23A of the
District of Columbia Municipal Regulations to clarify and reaffirm that the term
establishment continues to mean a business entity operating at a specific place or
location.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as
the "Alcoholic Beverage Control Clarification Amendment Act of 1999".
Sec. 2. Section 3 of the District of Columbia Alcoholic Beverage
Control Act, approved January 24, 1934 (48 Stat. 319; D.C. Code §25-103) is amended by
adding a new paragraph (29) to read as follows:
"(29) The word "establishment" means a business entity operating at a
specific location.
Sec. 3. Subsection 199.1 of Title 23A (DCMR) of the District of
Columbia Alcoholic Beverage Control Regulations is amended by adding a phrase at the end
of the phrase "Day — a calendar day." to read as follows:
"Establishment — a business entity operating at a specific
location.".
Sec. 4. Fiscal impact.
There is no fiscal impact.
Sec. 5. Effective date. This act shall take effect following approval
by the Mayor (or in the event of veto by the Mayor, action by the Council of the District
of Columbia to override the veto), approval by the Financial Responsibility and Management
Assistance Authority as provided in section 203(a) of the District of Columbia Financial
Responsibility and Management Authority Act of 1995, approved April 17, 1995 (109 Stat.
116; D.C. Code §47-392.3(c)), and a 30-day period of Congressional review as provided in
section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973
(Stat. 813; D.C. Code §1-233(c)(1)), and publication in the District of Columbia
Register.
