A BILL IN THE COUNCIL
OF THE DISTRICT OF COLUMBIA

Councilmember Jim Graham introduced the following bill, which was referred to the
Committee on Government Operations with comments from the Committee of the Whole and
Subcommittee on Human Rights, Latino Affairs, and Property Management.

To amend the District of Columbia Latino Community Development Act of 1976 and the
Confirmation Act of 1978 to require Commission nominees be subject to Council review and
confirmation.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as
the "Latino Economic Development Commission Confirmation Amendment Act of 2001".

Sec. 2. Section 402 of the District of Columbia Latino Community Development Act,
effective September 29, 1976 (D.C. Law 1-86; D.C. Code §1-2322), is amended by striking
the period at the end of the first sentence and inserting the phrase ", with the
advice and consent of the Council", in its place.

Sec. 3. Section 2(e) of the Confirmation Act of 1978, effective March 3, 1979 (D.C. Law
2-142; D.C. Code §1-633.7(e)), is amended as follows:

(a) Strike the phrase "paragraphs (1)-(26)" in the lead-in text and insert
the phrase "paragraphs (1)-(27)" in its place.

(b) Paragraph (25) is amended by striking the word "and".

(c) Paragraph (26) is amended by striking the period at the end and inserting the
phrase "; and" in its place.

(d) Add new paragraph (27) to read as follows:

"(27) The Commission on Latino Community Development, established by the District
of Columbia Latino Community Development Act, effective September 29, 1976 (D.C. Law 1-86;
D.C. Code § 1-2321)".

Sec. 4. There is no fiscal impact.

Sec. 5. This act shall take effect following approval by the Mayor (or in the event of
veto by the Mayor, action by the Council to override the veto), approval by the Fiscal
Responsibility and Management Assistance Authority, as provided by section 203(a) of the
District of Columbia Financial Responsibility and Management Assistance Act of 1995,
approved April 17, 1995 (109 Stat. 116; D.C. Code §47-392.3(a)), a 30day period of
Congressional review as provided in section 602(c)(1) of the District of Columbia Home
Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code §1-233(c)(1)), and
publication in the District of Columbia Register.
