A PROPOSED
RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
To declare the existence of an emergency
with respect to the need to provide adequate funding and ensure timely payments for public
schools and public charter schools, and to authorize disbursements while a
Continuing Resolution is in effect.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited
as the "Uniform Per Student Funding Formula For Public Schools and Public Charter
Schools Emergency Declaration Resolution of 2001 ".
Sec. 2. (a) There exists an immediate
crisis regarding funding for newly established public charter schools during the
period of a Continuing Resolution, and to ensure adequate and timely payment for public
charter schools that enroll alternative and special education students, and to stipulate a
special rule for public schools and public charter schools that enroll these students.
(b) Ambiguity also exists regarding the application of special needs add-on weights and
the implementation of public school and public charter school employee retirement
contributions.
(c) Adequate funding and disbursement processes need to be established on an emergency
basis to enable public schools and public charter schools to better service District of
Columbia students.
(d) This legislation will address the special enrollment circumstances of newly
established public charter schools that primarily serve level 4 and level 5 students and
will ensure adequate availability of funding.
Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Uniform Per Student Funding Formula For Public Schools and Public Charter Schools
Emergency Amendment Act of 2001 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
