A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
To confirm the appointment of Mr. Michael K. Martin to the Alcoholic Beverage Control
Board.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited
as the "Alcoholic Beverage Control Board Michael K. Martin Confirmation Resolution of
1999".
Sec. 2. The Council of the District of Columbia confirms the appointment of:

as chairman of the Board, established by section 4(a) of the District of Columbia
Alcoholic Beverage Control Act, effective May 24, 1994 (D.C. Law 10-122; D.C. Code
§25-104(a), completing the unexpired term of Barbara Lee Smith, whose term will end May
7, 2000.
Sec. 3. The Council of the District of Columbia shall transmit a copy of this
resolution, upon its adoption, each to the nominee and to the Office of the Mayor.
Sec. 4. This resolution shall have no fiscal impact.
Sec. 5. This resolution shall take effect immediately.

1994 — present:
Trial Attorney, United States Department of Justice, Environment and Natural Resources
Division, General Litigation Section, Washington, D.C. Serves as defense trial counsel in
lawsuits against the United States primarily involving allegations of Fifth Amendment
takings, physical and regulatory, without just compensation, and breaches of contracts.
Possesses experience in speculative oil and gas drilling, minerals management —
offshore and onshore, timber management and sales, and water rights. Also possesses
experience in Indian trust law, tribal recognition law, and Indian gaming law. Member of
bars of the District of Columbia, the United States Court of Appeals for the Federal
Circuit, and the United States Court of Federal Claims.
1983–1994:
Attorney, United States Merit it Systems Protection Board, Office of the General
Counsel, Washington, D.C. Provided legal advice and opinion to Presidentially appointed
members of the Merit Systems Protection Board Extensive experience representing the Board
in litigation before federal courts of appeals. Represented the Board in appeals of
personnel actions before Administrative Law Judges. Served as Freedom of Information Act
Counsel from January, 1988 through September, 1994. Received the Chairman’s Award for
Excellence in 1985 and 1989.
8/1993–12/1993:
The White House, Office of Presidential Personnel. Detailed as Assistant to Associate
Director, selecting candidates for Presidential appointments throughout the executive
branch.2/1988–5/1988:
Acting Legislative Counsel. Detailed during House and Senate appropriation hearings.
